Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Tokynera educational analytics platform and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you are using the Services on behalf of an educational institution or organization, you represent that you have the authority to bind that entity to these Terms.

Description of Services

Tokynera provides educational analytics software designed to help Japanese educational institutions and juku visualize student performance, test results, attendance, and academic progress. Our Services include:

  • Web-based analytics platform accessible through supported browsers
  • Data visualization and reporting tools
  • Student performance tracking and analysis features
  • Attendance monitoring capabilities
  • Custom report generation
  • Technical support and training resources

Account Registration and Use

To access our Services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring that your use complies with applicable laws and regulations

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

You retain ownership of all educational data you input into the Services. You grant us a limited license to process this data solely for the purpose of providing the Services to you.

The Services, including all software, content, trademarks, and other intellectual property, are owned by Tokynera or our licensors. These Terms do not grant you any ownership rights in the Services.

You may not copy, modify, distribute, sell, or create derivative works based on the Services without our express written permission.

Subscription and Payment

Access to certain features requires a paid subscription. Subscription terms include:

  • Fees are billed in advance on a monthly or annual basis
  • Subscriptions automatically renew unless cancelled
  • Price changes will be communicated with advance notice
  • Refunds are provided according to our refund policy
  • Failure to pay may result in service suspension

Service Availability

While we strive to provide reliable access to our Services, we do not guarantee uninterrupted availability. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice to users.

Limitation of Liability

Our total liability for any claims related to the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

We do not warrant that the Services will meet your requirements, be error-free, or operate without interruption.

Indemnification

You agree to indemnify and hold harmless Tokynera and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

Termination

Either party may terminate these Terms at any time. Upon termination:

  • Your access to the Services will cease
  • You remain responsible for any outstanding fees
  • We will handle your data according to our data retention policies
  • Provisions that by their nature should survive will continue to apply

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Services or via email. Continued use of the Services after changes become effective constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be resolved in the courts of Tokyo, Japan.
